These Terms of Use (“Terms”) govern your access to and use of Sensofy Lift, an application for Wix Stores merchants provided by SENSO GROUP UAB (“Sensofy”, “we”, “us”, or “our”), as well as related services provided by Sensofy.
By installing, accessing, or using Sensofy Lift, you agree to these Terms. If you do not agree to these Terms, do not install or use Sensofy Lift.
1. Sensofy Lift
Sensofy Lift is a software application designed for Wix Stores merchants.
The application enables merchants to create and manage quantity offers and tiered discounts, provide shoppers with quantity purchase options through supported Wix commerce surfaces, and access analytics relating to offer purchases and performance.
Sensofy Lift operates within and depends on the Wix platform and its commerce functionality.
2. Eligibility and Authority
You may use Sensofy Lift only if you are legally capable of entering into a binding agreement.
If you install or use Sensofy Lift on behalf of a business or other organization, you represent that you have authority to accept these Terms on behalf of that organization.
You are responsible for maintaining appropriate access to your Wix account and for activity performed through your account in connection with Sensofy Lift.
3. Wix Platform
Sensofy Lift is designed to integrate with Wix and Wix Stores.
Certain functionality depends on services, APIs, infrastructure, permissions, and commerce functionality provided by Wix. This may include products, variants, inventory, cart, checkout, discount rules, orders, payments, and application billing.
Your use of Wix remains subject to the applicable agreements and policies between you and Wix.
Sensofy does not control the Wix platform and is not responsible for changes, interruptions, restrictions, or failures of Wix services that are outside Sensofy’s reasonable control.
4. Offers and Store Configuration
You are responsible for the offers, quantities, discount levels, products, pricing, and other store settings you configure through Sensofy Lift.
You are responsible for reviewing your offer configuration and ensuring that offers displayed or made available in your store are accurate and appropriate for your business.
You are also responsible for complying with laws and regulations applicable to your store, products, pricing, discounts, advertising, taxes, and customer transactions.
Sensofy provides software functionality and does not determine the commercial terms you offer to your customers.
5. Subscriptions, Billing, and Payments
Paid access to Sensofy Lift is provided through the Wix application billing system.
Applicable subscription prices, billing periods, plan details, and available purchasing options are presented through Wix.
Wix handles subscription payment processing and may also handle applicable taxes, currency presentation, and related billing matters in accordance with Wix’s applicable terms and billing infrastructure.
Sensofy does not independently process or store payment card details for Sensofy Lift subscriptions.
Changes to subscriptions, cancellations, refunds, or other billing matters may also be subject to Wix’s applicable billing rules and policies.
6. Acceptable Use
You agree not to use Sensofy Lift:
- for unlawful, fraudulent, deceptive, or abusive purposes;
- in a way that infringes the rights of Sensofy, Wix, or any third party;
- to interfere with or disrupt the operation or security of Sensofy Lift or related systems;
- to attempt to gain unauthorized access to the application, infrastructure, accounts, or data;
- to reverse engineer, circumvent, exploit, or misuse the application except where such restriction is prohibited by applicable law;
- in a manner that violates applicable Wix terms, policies, or platform requirements.
We may restrict or suspend access where reasonably necessary to protect the service, users, Wix integrations, or our legal rights, or where these Terms are materially violated.
7. Intellectual Property
Sensofy Lift, the Sensofy website, Sensofy branding, software, interfaces, designs, documentation, and related materials are owned by or licensed to SENSO GROUP UAB and are protected by applicable intellectual property laws.
Subject to these Terms and any applicable subscription requirements, Sensofy grants you a limited, non-exclusive, non-transferable right to use Sensofy Lift for your own business purposes through the Wix platform.
These Terms do not transfer ownership of Sensofy Lift or any Sensofy intellectual property to you.
Wix and other third-party names, trademarks, products, and services remain the property of their respective owners.
8. Privacy and Data
Our processing of information in connection with Sensofy Lift is described in our Privacy Policy.
By using Sensofy Lift, you acknowledge that operation of the application may require processing of information made available through Wix as described in the Privacy Policy.
You remain responsible for your own obligations concerning personal data, privacy notices, customer information, and other data processed through your Wix store.
9. Service Availability and Changes
We aim to provide a reliable service, but we do not guarantee that Sensofy Lift will be available without interruption or error at all times.
From time to time, we may maintain, update, modify, improve, or discontinue parts of Sensofy Lift.
Some interruptions or changes may result from Wix, hosting providers, infrastructure providers, internet services, or other systems outside Sensofy’s reasonable control.
Where reasonably possible, we will seek to avoid unnecessary disruption to users.
10. Support
Support for Sensofy Lift is available through the support contact information provided by Sensofy.
When requesting support, you agree to provide information reasonably necessary for us to understand and resolve the issue.
Support does not include responsibility for unrelated Wix configuration, third-party applications, merchant business operations, or systems outside Sensofy Lift.
11. Third-Party Services
Sensofy Lift relies on Wix and may rely on other service providers necessary to host, secure, maintain, and operate the application.
Third-party services may be governed by their own terms and policies.
Sensofy is not responsible for third-party products or services to the extent that their operation is outside Sensofy’s reasonable control.
12. Disclaimer
Sensofy Lift is provided as a software service intended to assist merchants in creating and managing quantity offers and understanding related performance.
Sensofy does not guarantee any particular increase in revenue, average order value, sales, conversion rate, profit, or other business result.
Analytics and performance information provided by Sensofy Lift is intended to support merchant decision-making and should not be considered financial, accounting, tax, or legal advice.
To the maximum extent permitted by applicable law, the service is provided without warranties that are not expressly stated in these Terms.
13. Limitation of Liability
To the maximum extent permitted by applicable law, SENSO GROUP UAB will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or relating to the use of Sensofy Lift.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. Suspension and Termination
You may stop using Sensofy Lift and uninstall the application through Wix subject to any applicable Wix subscription and billing rules.
We may suspend or terminate access to Sensofy Lift where reasonably necessary because of a material violation of these Terms, unlawful or abusive use, security risk, or where required by law or applicable Wix platform requirements.
Termination does not affect rights or obligations that by their nature should survive termination.
15. Changes to These Terms
We may update these Terms when Sensofy Lift, our business practices, applicable platform requirements, or legal requirements change.
The “Last updated” date at the top of these Terms indicates when they were most recently revised.
Where required by applicable law, we will provide appropriate notice of material changes.
16. Governing Law
These Terms are governed by the laws of the Republic of Lithuania, without prejudice to any mandatory rights or protections that apply under the laws of your jurisdiction.
Any disputes relating to these Terms will be subject to the jurisdiction determined under applicable law.
